Terms and Conditions

1. Definitions

The following terms used in these Terms and Conditions shall have the meanings set out below:

  • Seller — KursVideoAI.PL, operating the website available at https://kursvideoai.pl, Tax Identification Number (NIP): 6372199254, contact: kontakt@kursvideoai.pl.
  • Customer — a natural person with full legal capacity, a legal entity, or an organisational unit without legal personality, who purchases the Course.
  • Course — the digital educational product "AI Video Creation Course" offered by the Seller in the form of PDF materials, prompt templates, and additional resources, available online after purchase.
  • Consultation — an individual, 60-minute 1-on-1 consulting service provided online by the Seller via Google Meet, booked and paid for in advance through the Cal.com platform.
  • Booking Operator — Cal.com, Inc., the platform handling Consultation booking and payment processing via the integrated Stripe system.
  • Service — the website available at https://kursvideoai.pl together with all its subpages.
  • Order — a declaration of intent by the Customer leading to the conclusion of a sales contract for the Course with the Seller, submitted via the Service.
  • Payment Operator — Stripe, Inc., the entity processing electronic payments.

2. General provisions

  • These Terms and Conditions govern the rules for using the Service and the conditions for purchasing and using the Course.
  • Using the Service constitutes acceptance of these Terms and Conditions.
  • These Terms and Conditions are made available free of charge via the Service in a form that allows them to be downloaded, saved, and printed.
  • To use the Course, the following are required: a device with internet access, an up-to-date web browser (Chrome, Firefox, Safari, Edge), and an active email account.

3. Terms of use of the Course

  • Access to the Course is granted upon payment and is lifetime (indefinite), provided that the Service remains available.
  • The Course includes access to all current materials as well as future updates and new modules added by the Seller.
  • The Customer gains access to the Course via a dedicated online platform. Access credentials are sent to the email address provided at the time of purchase.
  • The Customer undertakes to use the Course in accordance with its intended purpose and applicable law.
  • The Seller reserves the right to update, modify, and expand the Course materials in order to keep them current and of the highest quality.

4. Prices and payments

  • All prices shown on the Service are gross prices (inclusive of VAT) and are expressed in Polish zloty (PLN).
  • Payments are processed by Stripe, Inc. Stripe accepts card payments (Visa, Mastercard, American Express), BLIK, online bank transfers, and other payment methods available in a given region.
  • The sales contract is concluded at the moment the payment is confirmed by the Payment Operator.
  • A VAT invoice is issued upon request. To obtain an invoice, please contact us at kontakt@kursvideoai.pl.
  • The Seller reserves the right to change Course prices. A price change does not affect orders that have already been placed and paid for.

5. Right of withdrawal from the contract

A consumer has the statutory right to withdraw from a distance contract under the conditions described below. This right arises under Art. 27 of the Polish Act of 30 May 2014 on Consumer Rights, which implements EU Directive 2011/83/EU. The 14-day right of withdrawal is a mandatory right under Polish and EU consumer law and applies to consumers resident in the EU/EEA. Buyers residing outside the EU/EEA should note that their local consumer-protection law may differ; the Seller does not make representations about rights under non-EU legal systems.

  • 14 days from the date of conclusion of the contract (the date of purchase confirmation) to withdraw without giving a reason, pursuant to Art. 27 of the Polish Act of 30 May 2014 on Consumer Rights.
  • To exercise the right of withdrawal, send an unambiguous written declaration to: kontakt@kursvideoai.pl (for example: "I hereby withdraw from my contract for the purchase of the AI Video Creation Course concluded on [date]").
  • The refund will be issued within 14 days of the Seller receiving the withdrawal declaration, using the same payment method as the original purchase, at no cost to the Consumer.
  • Exception — digital content delivered with express consent: the right of withdrawal does not apply if the Seller has begun providing the digital content with the Consumer's prior express consent and after informing the Consumer that this consent results in the loss of the right of withdrawal, before the 14-day period has expired (Art. 38(13) of the Polish Act of 30 May 2014 on Consumer Rights). By completing the purchase and ticking the relevant checkbox, the Customer confirms such express consent.

6. Licence for course materials

  • Upon purchase, the Customer receives a non-exclusive, non-transferable licence to use the Course materials solely for their own personal and educational use.
  • The licence covers the right to read PDF materials, use prompt templates, and access additional resources provided as part of the Course.
  • The following are prohibited:
  • Copying, screen recording, downloading, or reproducing Course materials in whole or in part.
  • Sharing Course materials with third parties, including by sharing login credentials.
  • Distributing, reselling, sublicensing, or publicly making available the Course materials.
  • Using Course materials to create competing educational products.
  • Breach of the licence terms may result in immediate revocation of access to the Course without any right to a refund.
  • All materials made available as part of the Course (texts, graphics, templates) constitute the intellectual property of the Seller and are protected by copyright in accordance with the Polish Act of 4 February 1994 on Copyright and Related Rights.

7. Complaints

  • The Customer has the right to lodge a complaint in the event of non-performance or improper performance of the service by the Seller (e.g. lack of access to materials, technical errors preventing use of the Course).
  • Complaints should be submitted electronically to: kontakt@kursvideoai.pl.
  • A complaint should include: the Customer's full name, the email address used at the time of purchase, a description of the problem, and the expected resolution.
  • The Seller will process the complaint within 14 days of receipt and inform the Customer of the outcome by email.
  • If a complaint is upheld, the Seller will take corrective action (e.g. restoring access, fixing the issue) or propose another solution, including a refund.

8. Liability

  • The Seller makes every effort to ensure that the Course content is reliable, up to date, and useful. The Course is educational and informational in nature and does not constitute business, legal, or financial advice.
  • The Seller does not guarantee the achievement of specific financial or professional results from completing the Course. Results depend on individual factors, including the Customer's own engagement and effort.
  • The Seller shall not be liable for interruptions in access to the Course caused by technical reasons beyond the Seller's control (server failures, interruptions by hosting service providers, force majeure).
  • The Seller shall not be liable for changes to external AI tools discussed in the Course (e.g. changes to pricing, features, or availability of Runway, Sora, Kling, etc.).

9. Personal data protection

The controller of Customers' personal data is the Seller. Detailed information about the processing of personal data, including purposes, legal bases, retention periods, and your rights, can be found in the Privacy Policy.

10. Out-of-court dispute resolution

A Customer who is a consumer may use out-of-court means of resolving complaints and pursuing claims, including:

  • Submitting a request to the permanent consumer arbitration court operating at the Trade Inspection (Poland).
  • Seeking assistance from the district (municipal) consumer ombudsman (Poland).
  • Using the European Commission's Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr.

11. Final provisions

  • These Terms and Conditions are governed by Polish law. Matters not regulated herein shall be governed by applicable provisions of Polish law, in particular the Civil Code (Act of 23 April 1964), the Act of 30 May 2014 on Consumer Rights, and the Act of 18 July 2002 on the provision of electronic services. The application of mandatory consumer-protection provisions of a consumer's country of habitual residence (where required under EU Regulation (EC) No 593/2008 — Rome I) is not excluded.
  • Any disputes arising from these Terms and Conditions or the use of the Service shall be submitted to the competent common court in Poland, in accordance with Polish civil procedure rules. For Customers who are consumers, the court with jurisdiction over the consumer's place of residence shall also have competence, as provided by applicable law.
  • The Seller reserves the right to amend these Terms and Conditions. Customers will be informed of material changes by email at least 14 days in advance. Changes shall not affect orders placed before the date they come into force.
  • If any provision of these Terms and Conditions is found to be invalid or ineffective, the remaining provisions shall remain in full force and effect.

12. 1-on-1 consultations with the author

In addition to the Course, the Seller offers individual 1-on-1 Consultations. The terms of the Consultation service are set out below:

  • Scope of service: a 60-minute individual online session with the Course author, conducted in Polish via Google Meet. The Consultation includes an audit of the Customer's project or workflow and delivery of specific recommendations for AI video creation.
  • Price: 250 PLN gross (inclusive of VAT) per 60-minute session. The price is a one-off charge and is not subject to a subscription.
  • Booking and payment: The Customer books a slot via the Cal.com platform at cal.com/mercatoops/konsultacja. Payment is collected in advance by Stripe (debit/credit card, BLIK, Przelewy24). The contract is concluded upon payment confirmation.
  • Post-payment deliverables: automatic email confirmation, Google Meet link, and calendar invitation.
  • Post-session deliverables: within 24 hours of the Consultation, the Customer receives by email the session recording, transcription, and a list of agreed next steps. These materials are for the Customer's private use. The Seller provides email follow-up support for 7 days from the session date.
  • Rescheduling: The Customer may reschedule the Consultation once free of charge, no later than 24 hours before the scheduled session. Rescheduling is done via the link in the booking confirmation email.
  • Cancellation and refund: cancellation more than 24 hours before the session entitles the Customer to a full refund (processed automatically by Stripe). Cancellation less than 24 hours before the session or the Customer's no-show does not entitle the Customer to a refund, as the Seller's time has been reserved.
  • Cancellation by the Seller: if the Seller must cancel the session, the Customer may choose a new date or receive a full refund within 14 days.
  • Right of withdrawal (Consumers): a Consumer has a 14-day right to withdraw from the contract. This right expires if the Consultation is performed with the Consumer's express consent before the 14-day period from the conclusion of the contract has elapsed (Art. 38(1)(1) of the Polish Act of 30 May 2014 on Consumer Rights). The Customer confirms express consent to immediate commencement of the service at the time of booking via Cal.com, acknowledging that this results in the loss of the right of withdrawal once the Consultation has been performed.
  • VAT invoice: issued on request. To receive an invoice, the Customer provides billing details (VAT number, company name, address) in reply to the booking confirmation email. The invoice is sent to the provided email address within 24 hours of receiving the billing details.
  • Recording and transcription: the Seller records and transcribes the Consultation for the purpose of delivering them to the Customer after the session. The Customer accepts the recording by joining the meeting. The recording and transcription constitute the Customer's personal data and are processed solely for the purpose of performing the Consultation and delivering its results to the Customer. The Seller does not publish recordings without the Customer's express written consent.
  • Nature of recommendations: recommendations provided during the Consultation are expert in nature but do not constitute a guarantee of specific business results. Outcomes depend on the Customer's individual circumstances, industry, level of effort, and market factors beyond the Seller's control.
